The rules, in plain language.

When you sign up for Partake as a couple, you’re entering an agreement with Partake Inc. When your guests use Partake at your wedding, they’re using the service you set up. These terms cover both.

If anything in this document is unclear, email hello@partakeweddings.com and we’ll explain it in plain language. We prefer conversations to lawsuits.

Partake is a web-based guest experience with no app downloads. Features vary by package. The two visible packages are Partake Photos ($149) and Partake Full ($349). Every package includes a memory portal kept for 12 months from the wedding date, with unlimited couple-side exports during that window.

We keep a 99% uptime target. If we’re down during your actual wedding ceremony or reception and it’s our fault, we’ll refund your package in full. That promise isn’t hedged: if your event is live and Partake is broken, you get your money back. Email us from the couple account that booked the event.

Packages are charged in two parts: a 25% deposit at booking and the remaining 75% auto-charged 30 days before your wedding. Both payments are processed by Stripe; we never hold card details ourselves.

Deposit refunds:the deposit is refundable if you cancel more than 6 months before the wedding. Inside 6 months it’s non-refundable because we’re already holding that slot and running the event infrastructure for you.

Final payment refunds:the final payment is fully refundable if you cancel more than 30 days before the wedding. Inside 30 days it’s non-refundable.

Failed auto-charge:if the final payment fails, we retry 3 times over 5 days and send you an email each time. If it still hasn’t gone through after that, the event is locked (read-only) until payment is sorted out. No data is deleted during a lock.

After you’ve paid your deposit you get a unique referral link. If another couple signs up through your link and pays their deposit, you earn a $20 credit applied to your final payment. Credits are capped at $60 per couple (3 paid referrals). The friend you referred always gets $10 off their package.

Credits are never paid out as cash, can never result in a negative balance, and are forfeited if you cancel the event. The cap is hard: once you’ve hit $60, further referrals still get the friend discount but earn no additional credit.

As the couple running the event, you agree that you have the right to upload anything you upload (cover photo, love story, RSVP list, trivia, etc.) and that it’s not defamatory, harassing, or illegal. Partake is not going to police event content, but we reserve the right to remove an event if we receive a credible complaint that something on it is harmful.

You’re responsible for letting your guests know that Partake is in use and that their uploads are shared with the other guests and with you. Our name-entry screen shows this notice, but you should be upfront about it in your physical signage too.

Guests own what they upload. By uploading something to a Partake event, a guest grants the couple the right to view, export, download, print, and keep a copy. Guests also grant us the minimum rights we need to actually run the feature (store the file, show it in the gallery, include it in the memory portal export). We don’t use guest content for marketing or training.

Guests can delete their own uploads any time via the “Delete my data” footer button. Couples can remove anything inappropriate from their memory portal. Photos flagged by a guest are hidden from the gallery immediately and land in the couple’s moderation queue.

Don’t use Partake to upload hateful, harassing, sexually explicit, or illegal content. Don’t scrape, probe, or overload the service. Don’t try to access other couples’ events. Don’t use Partake to spam people or to distribute malware.

If we believe in good faith that an account or event is violating these rules, we may pause the event while we investigate and, if needed, remove it. Serious violations are a termination cause.

The Partake name, logo, design system, The Partake Wizard brand, and the codebase that runs this product are ours. Nothing in these terms gives you the right to use the Partake name to promote other services, or to copy the product in a way that confuses real couples.

Partake is provided as-is. We work hard to keep it reliable, but software has bugs and the internet has bad days. Beyond the uptime promise described in What you get, we don’t promise that every feature will work perfectly in every browser on every network at every moment.

To the maximum extent allowed by law, Partake’s total liability for anything related to the service is capped at the total amount you’ve paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

If we ever change these terms in a way that materially affects existing customers, we’ll email every active couple before the change takes effect. Minor wording edits can ship without notice but will update the “last updated” date below.

These terms are governed by the laws of the state of Delaware, USA, without regard to conflicts of laws rules. Any dispute that can’t be resolved by email goes to a court in Delaware.
